1. Acceptance of Terms

By accessing or using AI Briefly ("the Service"), including the website at aibriefly.com, newsletters, and consulting services, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

You must be at least 18 years of age to use this Service. AI Briefly publishes content related to investment analysis, and this content is intended for adults who are capable of making their own financial decisions. By using the Service, you represent and warrant that you are at least 18 years old.

2. Description of Service

AI Briefly publishes analysis of artificial intelligence industry developments for investment professionals. The Service includes a free daily digest, premium deep dives, research paper analysis, and consulting sessions. AI Briefly is operated by Mallika Iyer and is not a registered investment advisor, broker-dealer, or financial planner.

3. Investment Disclaimer

  • AI Briefly does not make buy, sell, or hold recommendations for any security, asset, or financial instrument.

AI Briefly offers consulting sessions at $1,000 per hour. These sessions provide expert technical analysis of AI industry developments and are not investment advisory services. Consulting engagements do not create a fiduciary relationship, an advisor-client relationship, or any obligation to provide investment recommendations. All consulting output is for informational purposes only.

5. Intellectual Property

AI Briefly's original analysis, commentary, design, and presentation are the intellectual property of AI Briefly and Mallika Iyer. All rights are reserved unless otherwise stated.

AI Briefly frequently references and analyzes news, research, and data from third-party sources. Original reporting, data, and research belong to their respective publishers. AI Briefly's use of such material constitutes fair use commentary and criticism under U.S. copyright law. AI Briefly does not claim ownership of third-party content.

6. Copyright and DMCA Policy

AI Briefly respects the intellectual property rights of others. If you believe that your copyrighted work has been used in a way that constitutes copyright infringement, please submit a DMCA takedown notice to legal@aibriefly.com with the following information:

  • A description of the copyrighted work you claim has been infringed.
  • A description of where the allegedly infringing material is located on the Service.
  • Your contact information (name, address, phone number, email).
  • A statement that you have a good-faith belief that the use is not authorized by the copyright owner.
  • A statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on their behalf.

If you submit content to AI Briefly - including but not limited to comments, feedback, or questions - you grant AI Briefly a non-exclusive, royalty-free, perpetual, worldwide license to use, reproduce, modify, and display such content in connection with the Service. You retain ownership of your content but are responsible for ensuring you have the right to share it.

8. Third-Party Links

The Service may contain links to third-party websites, articles, and resources. AI Briefly provides these links for reference and convenience. AI Briefly does not endorse, control, or assume responsibility for the content, privacy policies, or practices of any third-party sites. You access third-party content at your own risk.

9. Conflicts of Interest

AI Briefly provides both editorial analysis and consulting services. When a topic covered in AI Briefly's editorial content intersects with an active consulting relationship, AI Briefly will disclose that conflict. AI Briefly strives to maintain editorial independence regardless of consulting engagements.

10. Indemnification

You agree to indemnify, defend, and hold harmless AI Briefly, Mallika Iyer, and any affiliates, officers, agents, or contractors from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

11. Limitation of Liability

To the maximum extent permitted by applicable law, AI Briefly and its operator shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of the Service.

In no event shall AI Briefly's total liability to you for all claims arising out of or relating to the Service exceed the total amount of fees paid by you to AI Briefly during the twelve (12) months immediately preceding the event giving rise to the claim. If you have not paid any fees, AI Briefly's total liability shall not exceed one hundred dollars ($100).

12. Warranty Disclaimer

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. AI BRIEFLY DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE. AI BRIEFLY DOES NOT WARRANT THE ACCURACY, RELIABILITY, OR COMPLETENESS OF ANY CONTENT PROVIDED THROUGH THE SERVICE. YOU USE THE SERVICE AT YOUR OWN RISK.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of New York, United States, without regard to its conflict of law provisions.

14. Dispute Resolution and Arbitration

Any dispute, controversy, or claim arising out of or relating to these Terms or the Service shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) in accordance with its Commercial Arbitration Rules. The arbitration shall take place in New York, New York. The arbitrator's decision shall be final and binding.

Class Action Waiver: You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. You waive any right to participate in a class action lawsuit or class-wide arbitration against AI Briefly.

15. Changes to Terms

AI Briefly reserves the right to modify these Terms at any time. If we make material changes, we will notify you by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after changes are posted constitutes your acceptance of the revised Terms.
